The European Circle for Competition Damages, the association of which our lawyers Pedro Suárez and Javier Pérez are founding members, has submitted its comments on the CNMC's draft guide on quantification of damages for competition infringements

In the framework of the public consultation launched by the CNMC to gather opinions on the drafting of this Guide on the quantification of damages for competition infringements, Pedro Suárez and Javier Pérez have actively participated in the comments submitted by the European Circle for Competition Damages.

The Circle welcomes and comments on the Draft Guide on the quantification of damages by the Spanish Competition Authority.

The European Circle for Competition Damages (“The Circle”) welcomes the opportunity to submit its comments on the Draft Guide on the quantification of damages for competition infringements, submitted for public consultation by the Spanish Competition Authority (National Commission for Markets and Competition/ Comisión Nacional de los Mercados y la Competencia or “CNMC”).

The Spanish Competition Authority, within the framework of its advisory functions, recently opened a public consultation on the elaboration of a guide for quantifying competition damages. The CNMC’s Promotion department, in collaboration with the CNMC’s Legal Service and Economic Service, drafted a preliminary working document (“Draft Guide”) with a view to receiving comments from stakeholders. The Draft Guide will eventually be submitted to the CNMC’s Council for approval.

The Circle is a cooperation network of lawyers from premier boutique law firms, economists, service providers and other leading professionals specialised in the private enforcement of competition law in Europe. Its objective is to promote the study and enforcement of the rules and techniques for the compensation of antitrust damages. The Circle exclusively focuses on the enforcement of claims for damages resulting from cartel behaviour and/or the abuse of market dominance, as well as legal actions and/or other measures regarding such infringements. The Circle members have acted in prominent and high-profile cases of private enforcement of competition law across the EU. Besides this unparalleled joint practical experience, each member has in-depth knowledge of EU law as well as the law of one or more relevant jurisdictions, and/or the quantification of competition damages.

The Circle submits, by agreement of its members, its comments and observations to the CNMC’s public consultation.

The comments and observations do not necessarily reflect the view of all the members of the Circle.
